AN ACT relating to professional corporations; allowing the formation of certain professional corporations; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 89.050 is hereby amended to read as follows:

1-2  89.050  1.  Except as otherwise provided in subsection 2, a

1-3  professional corporation may be organized only for the purpose of

1-4  rendering one specific type of professional service and may not

1-5  engage in any business other than rendering the professional service

1-6  for which it was organized and services reasonably related thereto,

1-7  except that a professional corporation may own real and personal

1-8  property appropriate to its business and may invest its money in any

1-9  form of real property, securities or any other type of investment.

1-10      2.  A professional corporation may be organized to render a

1-11  professional service relating to:

1-12      (a) Architecture, interior design, residential design, engineering

1-13  and landscape architecture, or any combination thereof, and may be

1-14  composed of persons:

1-15          (1) Engaged in the practice of architecture as provided in

1-16  chapter 623 of NRS;

1-17          (2) Practicing as a registered interior designer as provided in

1-18  chapter 623 of NRS;


2-1       (3) Engaged in the practice of residential design as provided

2-2  in chapter 623 of NRS;

2-3       (4) Engaged in the practice of landscape architecture as

2-4  provided in chapter 623A of NRS; and

2-5       (5) Engaged in the practice of professional engineering as

2-6  provided in chapter 625 of NRS.

2-7  (b) Medicine, homeopathy and osteopathy, and may be

2-8  composed of persons engaged in the practice of medicine as

2-9  provided in chapter 630 of NRS, persons engaged in the practice of

2-10  homeopathic medicine as provided in chapter 630A of NRS and

2-11  persons engaged in the practice of osteopathic medicine as provided

2-12  in chapter 633 of NRS. Such a professional corporation may market

2-13  and manage additional professional corporations which are

2-14  organized to render a professional service relating to medicine,

2-15  homeopathy and osteopathy.

2-16      (c) Mental health services, and may be composed of the

2-17  following persons, in any number and in any combination:

2-18          (1) Any psychologist who is licensed to practice in this

2-19  state;

2-20          (2) Any social worker who holds a master’s degree in social

2-21  work and who is licensed by this state as a clinical social worker;

2-22          (3) Any registered nurse who is licensed to practice

2-23  professional nursing in this state and who holds a master’s degree

2-24  in the field of psychiatric nursing; and

2-25          (4) Any marriage and family therapist who is licensed by

2-26  this state pursuant to chapter 641A of NRS.

2-27  Such a professional corporation may market and manage

2-28  additional professional corporations which are organized to

2-29  render a professional service relating to mental health services

2-30  pursuant to this paragraph.

2-31      3.  A professional corporation may render a professional service

2-32  only through its officers and employees who are licensed or

2-33  otherwise authorized by law to render the professional service.

2-34      Sec. 2.  This act becomes effective upon passage and approval.
