Senate Concurrent RESOLUTION—Directing the Legislative Commission to conduct an interim study of the feasibility and desirability of changing the state boundary line along the border with Utah.

 

1-1  Whereas, In a local referendum on November 5, 2002, the

1-2  residents of the cities of West Wendover, Nevada, and Wendover,

1-3  Utah, voted to approve a merger of the two cities; and

1-4  Whereas, The annexation of Wendover, Utah, to the State of

1-5  Nevada will result in a change in the boundary line between the two

1-6  states; and

1-7  Whereas, The consulting firm Applied Development

1-8  Economics of Berkeley, California, recently conducted a limited

1-9  study for the cities of West Wendover and Wendover, funded in part

1-10  by the United States Department of Agriculture, that indicated a

1-11  merger would provide benefits for both cities; and

1-12      Whereas, A change in the boundary line between Nevada and

1-13  Utah must be agreed upon by the two states in an interstate

1-14  agreement or compact enacted by the Legislature of each state; and

1-15      Whereas, There are several issues that must be examined and

1-16  evaluated before the step of redrawing a long-standing state

1-17  boundary can be taken; now, therefore, be it

1-18      Resolved by the Senate of the State of Nevada, the

1-19  Assembly Concurring, That the Legislative Commission is

1-20  hereby directed to appoint a committee of four Legislators

1-21  composed of two members of the Senate and two members of the


2-1  Assembly to study the feasibility and desirability of a change in the

2-2  boundary line between Nevada and Utah; and be it further

2-3  Resolved, That the Legislative Commission shall provide for

2-4  the per diem allowance and travel expenses provided by law for

2-5  state officers and employees generally, to allow the members of this

2-6  committee and appropriate staff to meet and work cooperatively

2-7  with their counterparts from the Utah State Legislature; and be it

2-8  further

2-9  Resolved, That the study must include a review of the 2002

2-10  Wendover Annexation Study conducted by Applied Development

2-11  Economics of Berkeley, California; and be it further

2-12      Resolved, That the study must include, without limitation, an

2-13  examination and evaluation of the potential impact of such a merger

2-14  upon the economic, educational, fiscal, professional and social

2-15  health and well-being of the two communities; and be it further

2-16      Resolved, That the Committee is directed to communicate

2-17  with members of the Utah State Legislature to achieve the goals set

2-18  forth and, if appropriate, prepare a draft of language to be used in an

2-19  interstate agreement or compact to change the boundary; and be it

2-20  further

2-21      Resolved, That on or before September 1, 2004, the

2-22  Committee shall prepare and submit a report of its findings and any

2-23  recommendations for legislation to the Director of the Legislative

2-24  Counsel Bureau for transmittal to the Legislative Commission; and

2-25  be it further

2-26      Resolved, That the Legislative Commission shall submit a

2-27  report of the results of the study and any recommendations for

2-28  legislation to the 73rd Session of the Nevada Legislature.
