Senate Concurrent RESOLUTION—Directing the Legislative Committee on Public Lands to conduct an interim study of the feasibility and desirability of changing the state boundary line along the border with Utah.

 

1-1  Whereas, In a local referendum on November 5, 2002, the

1-2  residents of the cities of West Wendover, Nevada, and Wendover,

1-3  Utah, voted to approve a merger of the two cities; and

1-4  Whereas, The annexation of Wendover, Utah, to the State of

1-5  Nevada will result in a change in the boundary line between the two

1-6  states; and

1-7  Whereas, The consulting firm Applied Development

1-8  Economics of Berkeley, California, recently conducted a limited

1-9  study for the cities of West Wendover and Wendover, funded in part

1-10  by the United States Department of Agriculture, that indicated a

1-11  merger would provide benefits for both cities; and

1-12      Whereas, A change in the boundary line between Nevada and

1-13  Utah must be agreed upon by the two states in an interstate

1-14  agreement or compact enacted by the Legislature of each state; and

1-15      Whereas, There are several issues that must be examined and

1-16  evaluated before the step of redrawing a long-standing state

1-17  boundary can be taken; now, therefore, be it

1-18      Resolved by the Senate of the State of Nevada, the

1-19  Assembly Concurring, That the Legislative Committee on

1-20  Public Lands is hereby directed to conduct an interim study of the


2-1  feasibility and desirability of a change in the boundary line between

2-2  Nevada and Utah; and be it further

2-3  Resolved, That the Legislative Commission shall appoint one

2-4  additional member of the Senate and one additional member of the

2-5  Assembly to assist in conducting the study; and be it further

2-6  Resolved, That the study must include a review of the 2002

2-7  Wendover Annexation Study conducted by Applied Development

2-8  Economics of Berkeley, California; and be it further

2-9  Resolved, That the study must include, without limitation, an

2-10  examination and evaluation of the potential impact of such a merger

2-11  upon the economic, educational, fiscal, professional and social

2-12  health and well-being of the two communities; and be it further

2-13      Resolved, That the Legislative Committee on Public Lands

2-14  may appoint and consult with an advisory committee for the

2-15  purposes of this study; and be it further

2-16      Resolved, That the members of the advisory committee serve

2-17  without compensation and per diem allowances, travel expenses or

2-18  other reimbursement; and be it further

2-19      Resolved, That the members of the Legislative Committee on

2-20  Public Lands are directed to meet, communicate and work

2-21  cooperatively with members of the Utah State Legislature to achieve

2-22  the goals set forth and, if appropriate, prepare a draft of language to

2-23  be used in an interstate agreement or compact to change the

2-24  boundary; and be it further

2-25      Resolved, That on or before September 1, 2004, the

2-26  Legislative Committee on Public Lands shall prepare and submit a

2-27  report of its findings and any recommendations for legislation to the

2-28  Director of the Legislative Counsel Bureau for transmittal to the

2-29  Legislative Commission.
